Terms and conditions

1. Introduction

By contacting me, Karim Abboud (the “Buyer”) for the purpose of selling your used car, you agree to these Terms and Conditions. These terms apply to all communication and transactions related to the purchase of used vehicles for personal use. I am a private buyer and do not engage in commercial activity, resale, or business operations.

2. Private Buyer Status

I am purchasing vehicles solely for personal use and not for resale. As such, the purchase is not a commercial transaction and does not involve any warranty, guarantee, or return policy, except where explicitly agreed upon.

3. Vehicle Sale Agreement

Upon agreeing to a purchase, the Buyer and Seller will create a vehicle sale contract (Kaufvertrag), which will outline the following details:

  • Vehicle Information: Make, model, year, mileage, registration number, and VIN.
  • Price: The agreed-upon purchase price.
  • Payment Terms: Full payment must be made before the vehicle is handed over. Payment can be made via bank transfer, certified check, or cash (at the seller’s discretion).
  • Condition: The Seller confirms the vehicle’s condition and provides full disclosure of any known issues or accidents. The Buyer reserves the right to inspect the car and request relevant documents, including service records and TÜV (inspection) certificates.

4. No Warranty or Guarantee

As a private buyer, I do not offer or expect any warranty or guarantee on the vehicles purchased unless otherwise agreed in writing. The vehicle is purchased as-is and no claims can be made for defects after the transaction is completed.

5. Inspection and Test Drive

It is the responsibility of the Buyer to arrange an inspection of the vehicle before agreeing to purchase. A test drive and inspection by a professional mechanic may be conducted, at the Buyer’s expense.

6. Payment Terms

Payment for the vehicle must be received in full before any transfer of ownership, including the handover of registration documents. The Seller will not transfer the vehicle until the agreed payment has been confirmed. The Buyer will receive a receipt or proof of payment upon completing the transaction.

7. Vehicle Ownership Transfer

Once the vehicle is sold, ownership will be transferred from the Seller to the Buyer. The Buyer is responsible for:

  • Registering the vehicle under their name at the Zulassungsstelle (Registration Office).
  • Ensuring that they have valid insurance (eVB-Nummer) before taking possession of the vehicle.
  • The Seller must provide the Buyer with the necessary documents, including the Fahrzeugbrief (vehicle registration document) and Fahrzeugschein (vehicle certificate).

8. Seller’s Responsibilities

The Seller is responsible for providing accurate and complete information about the vehicle, including but not limited to:

  • Any existing defects, accidents, or repairs.
  • Proof of TÜV (technical inspection) certification or the vehicle’s next inspection due date.
  • Ownership documentation and any relevant service records.

9. Privacy and Data Protection

Any personal data provided by the Seller (such as name, address, contact details) will only be used for the purpose of completing the sale and communication between the Buyer and Seller. The Buyer commits to handling all personal data in compliance with the General Data Protection Regulation (GDPR).

10. Dispute Resolution

In the event of a dispute arising from the sale, both parties agree to attempt to resolve the matter through amicable negotiations. If a resolution cannot be reached, disputes will be governed by German law.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Germany.
